Right of Withdrawal

Consumers generally have a right of withdrawal if they conclude a legal transaction for purposes that can predominantly be attributed neither to their commercial nor to their self-employed professional activity. However, the right of withdrawal applies only under certain conditions and for certain types of contracts. In the case of purchasing a digital product, e.g. a software product, you expressly agree that you waive the right of withdrawal as soon as we begin performing the contract. This means that after receiving the product (product code and download link), you lose your right of withdrawal in accordance with Section 356 (5) BGB. This provision applies specifically to digital content, regardless of whether the content is fully downloaded or made visible during the download.

The right of withdrawal therefore expires for this type of digital product. Nevertheless, we grant our customers a goodwill withdrawal option, which may allow a return in special cases.

Included: What is covered by the goodwill withdrawal?

• Incorrect product codes that do not match the product: If the received product code does not match the purchased product.
• Product codes that cannot be activated: If the product code is blocked or does not work for other reasons.
• Exhausted/used product codes: If the product code has already been used and no longer works.
• Serious errors on our part: In the event of faulty product delivery or incorrect product information.

Excluded: What is NOT covered by the goodwill withdrawal?

• Product code on unsupported systems: Activation on unsupported systems.
• Product code on unsupported devices: Use on unsupported devices.
• Wrong websites: Activation on unsupported voucher/redeem websites.
• Refusal to install the software: If the supplied software is not installed.
• Software purchased twice: If the product was purchased elsewhere and is no longer needed.
• Cooperation in installation processes: Failure to follow the manufacturer's instructions.
• Incompatibility: In the case of hardware/software problems not caused by us.

Exercising the right of withdrawal

To exercise your goodwill withdrawal, please contact us by email at support@softwarebay.de with a clear statement that you wish to withdraw from the contract. The attached sample withdrawal form is optional.

Return conditions

Regardless of the statutory right of withdrawal and the goodwill withdrawal, we offer our customers a voluntary 30-day return option for products that have not been redeemed. This begins on the day you receive the product (e.g. product code and download link).

The prerequisite is that the product code has not been redeemed or not been used .

After review and confirmation, we will refund the purchase amount using the originally selected payment method.

This return option applies in addition to your statutory rights and does not restrict them.

Consequences of withdrawal

If you exercise your right of withdrawal, we will reimburse all payments received from you, including delivery costs (provided that no more expensive type of delivery was chosen), no later than within 3 days after receipt of your withdrawal declaration. The repayment will be made using the same means of payment used for the original transaction, without any additional fees.

We may refuse the repayment until we have received the goods back or you have provided evidence that you have returned the goods. You must return the goods without undue delay and at the latest within 3 days from the day on which you communicate your withdrawal to us. We bear the return costs – any loss in value of the goods is your responsibility.

Exclusion / early expiry of the right of withdrawal

The right of withdrawal expires early for contracts for the delivery of sealed software, audio or video recordings. If the seal is removed after delivery or the software/product code is used, the right of withdrawal expires in accordance with the statutory provisions.
