Right of Withdrawal

1. Statutory Right of Withdrawal for Consumers

Consumers are generally entitled to a statutory right of withdrawal of 14 days in distance contracts.

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed.

2. Start of the Withdrawal Period

For contracts regarding digital content not supplied on a tangible medium, the withdrawal period begins as a rule upon conclusion of the contract.

3. Exercising the Right of Withdrawal

To exercise the right of withdrawal, you must inform us of your decision to withdraw from this contract by means of an unambiguous statement.

To meet the withdrawal deadline, it is sufficient to send the communication exercising the right of withdrawal before the withdrawal period expires.

4. Special Note on Digital Content

Our products are generally digital content not supplied on a tangible medium, in particular software licences, product keys, activation codes and download authorisations.

For such digital content, the statutory right of withdrawal expires prematurely if you expressly agree that we begin performing the contract before the withdrawal period expires, and you confirm that you thereby lose your right of withdrawal once performance of the contract has begun.

Performance of the contract generally begins upon provision of the product key, activation code, download link or other access to the digital content.

5. Consequences of Withdrawal

If you withdraw from this contract validly, we shall reimburse all payments received from you without undue delay and in any event no later than 14 days from the day on which we receive notification of your withdrawal.

We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise.

As our products are generally digital, no physical return shipment is required.

6. Electronic Withdrawal Function from 19 June 2026

To the extent required by law, we provide consumers with an additional electronic withdrawal function on our website.

After submitting a withdrawal via this function, consumers will immediately receive confirmation of receipt on a durable medium, generally by e-mail.

7. Voluntary 30-Day Return for Unredeemed Digital Products

Independent of statutory rights, we offer a voluntary 30-day return option for eligible digital products.

This voluntary return applies only if the product key, licence key, activation code or serial code has not yet been redeemed, activated, registered or used.

The return period begins on the date the digital product is provided.

The return is free of charge for you. No shipping costs or restocking fees apply. Returns are initiated by e-mail to support@softwarebay.de.

8. Cases Where We Review Replacement or Refund

• The code delivered does not match the product purchased.
• The delivered code was already used or is no longer usable.
• The delivered code cannot be activated despite compliance with product requirements.
• An incorrect product was delivered due to an error on our part.
• The product description was objectively materially incorrect.

9. Cases Where Return or Refund Is Generally Excluded

• The code has already been redeemed, activated, registered or used.
• The product is to be used on an unsupported system, device, account, region or platform.
• Installation, activation or manufacturer instructions were not followed.
• A compatibility issue exists that was not caused by us.
• The product was accidentally purchased twice, even though the delivered item is properly usable.
• There is no actual defect or incorrect delivery.

10. Refunds – General Conditions

Approved refunds – whether arising from statutory withdrawal, voluntary return or justified complaints – are made using the same means of payment as the original transaction, unless expressly agreed otherwise.

Processing time is generally up to 3 business days after positive review and approval.

No restocking fees apply. The return and refund process is free of charge for the customer. Returns are made by mail; a return form is available as a free download and printout.

If you wish to withdraw from the contract, you may use the model withdrawal form below. The form is available to you as a free download and printout. Use of this form is not mandatory – an informal e-mail to support@softwarebay.de is equally sufficient.
